Terms of Service

PlayHim PlayHer is operated by Kaham Inc. ("we", "us"). Using PlayHim PlayHer means you agree to these Terms and to the policies referenced in them, including the Safety Guidelines and Privacy Policy.

You must be legally capable of agreeing to these Terms.

The service is not intended for children under 13.

PlayHim PlayHer assists you with creating communications and hosts private Play pages that you choose to share. We do not independently deliver Plays to a recipient's phone number, social-media account, or email address.

You are responsible for:

• •Your sender/display identity
• •Your decision to create a Play
• •Who receives your Play link
• •How and where you share it
• •Ensuring your use complies with applicable law

You see and approve the final message before creating a Play.

After a Play is created, its message is locked.

Changing the communication requires creating another Play.

AI-generated content may occasionally contain errors, inappropriate wording, or unintended interpretations.

You must review messages before approving them.

PlayHim PlayHer does not guarantee that generated content is factually accurate or appropriate for every situation.

The Safety Guidelines form part of these Terms. You may not use PlayHim PlayHer for threats, harassment, stalking, repeated unwanted contact, hate or discriminatory abuse, impersonation, misuse of someone's private or sensitive information, sexual exploitation, scams or fraud, blackmail or extortion, illegal activity, attempts to evade a recipient's block, or any other harmful misuse.

Recipients may report Plays and use the blocking controls available to them.

PlayHim PlayHer may investigate misuse and restrict accounts where appropriate.

You may obtain Plays individually, through packs, or through subscription offerings when available. Prices and what each purchase includes are displayed before you buy.

A Play credit is consumed when a Play is successfully created, not merely when a draft message is generated.

Purchased non-subscription Play credits remain associated with your account subject to these Terms and applicable law.

Subscription allowances are governed by the subscription terms displayed at purchase.

Generated messages are not legal, medical, mental-health, financial, employment, or other professional advice.

The service may occasionally be unavailable, interrupted, modified, or updated.

PlayHim PlayHer may suspend or terminate access for serious or repeated violations of these Terms or the Safety Guidelines.

The service is provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the service will be uninterrupted, error-free, or that any message will achieve a particular outcome.

To the extent permitted by applicable law, PlayHim PlayHer is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or the actions or reactions of any recipient or third party arising from your use of the service. Nothing in these Terms limits liability that cannot be limited by law.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules.
